Agreement to Legal Terms

Our Services

We offer two primary service packages for website development:

  • Subscription Package includes monthly payment of $180 with $500 setup
  • Lump Sum Package requires $3,900 upfront plus $40 monthly hosting
  • Optional support add-on available for $70 per month
  • Custom hand-coded websites with no WordPress or builders
  • Development timeline typically 2-4 weeks

Service Terms

For subscription clients, we require:

  • Minimum commitment of twelve (12) months required
  • Early cancellation requires payment up to $3,900
  • Monthly payments must be made on time
  • 30 days notice required for cancellation after minimum term
  • No refunds on setup fees

Intellectual Property Rights

Ownership and rights are distributed as follows:

  • Company retains ownership of all website code and design
  • Clients own their domain name and business content
  • Subscription clients receive usage rights during active subscription
  • Lump sum clients receive perpetual license to use website
  • No resale or transfer without permission

Website Usage and Conduct

Users agree not to:

  • Attempt unauthorized access to systems
  • Upload malicious code or content
  • Interfere with site functionality
  • Use services for illegal purposes
  • Copy or reverse engineer code

Payment Terms

Our billing process includes:

  • Invoices sent via email with payment instructions
  • Seven day grace period for all payments
  • Late fee of $25 applies after grace period
  • Credit cards accepted for subscription payments
  • Bank transfers preferred for lump sum payments

Limitation of Liability

We limit our liability as follows:

  • Services provided AS IS without warranty
  • No liability for server downtime beyond our control
  • No responsibility for third-party service interruptions
  • Limited liability for data loss or business interruption
  • No liability for consequential damages

Privacy and Security

We implement the following measures:

  • Secure coding practices for all websites
  • Regular security monitoring and updates
  • Protection of customer data and information
  • Compliance with Australian privacy laws
  • Secure payment processing systems

Termination

Services may be terminated under these conditions:

  • Repeated late payments may trigger termination
  • Violation of terms leads to immediate termination
  • Illegal activities result in instant termination
  • Company may terminate with 30 days notice
  • Client termination requires completion of minimum term
